Bengaluru: A consumer court has directed an outlet stitching saree borders to reimburse Rs 31,975 to retired District and Sessions Judge MS Evani and his wife Mangala Evani for damaging an expensive Mysore Silk saree.

The petitioners, MS Evani, and his wife Mangala Evani had submitted the original bill of Rs 21,975 paid for the saree in August 2019 as well as the slip from ‘Divena Couture’ dated October 29, 2019, acknowledging receipt of saree for stitching.

The Consumer Commission, hearing the case directed NC Divya of ‘Divena Couture’ to compensate the complainants’ Rs 31,975 towards the cost of the saree and Rs 5,000 towards damages and Rs 5,000 for litigation expenses.

In her response Divya stated that she had kept aside the clothes received from the complainants without checking it as she was busy at the time. Later when they opened the saree for stitching the border, they noticed that it was burnt in two places and duly informed Mangala.

She further claimed that the saree had been used when given for border stitching.

The Commission however noted that the shop is duty-bound to check the condition of the cloth received for stitching and not doing so amounts to negligence. As the branded saree is burnt in two places, it cannot be worn and thus the complainants should be compensated, ordered the Commission.
