Panambur: The Supreme Court has deferred the bail plea hearing of the accused arrested in connection with the alleged abetment of suicide of Misbah Education Institution Chairman B M Mumtaz Ali, brother of former MLA Mohiuddin Bava, to January 9. The accused will remain in judicial custody until then.
Family members had filed a complaint at the Kavoor Police Station, alleging that Ayesha, Shoaib, Sattar, and others had orchestrated a honey trap to extort money from the deceased. Based on the complaint, the accused were arrested, and legal action was initiated.
The defense lawyers argued that the accused are eligible for bail as the police failed to file a charge sheet within 60 days. The local and High Courts considered this and directed bail.
However, representing Mumtaz Ali’s family, advocate P.P. Hegde argued that under the new Criminal Procedure Code, authorities have a 90-day time frame, making the bail ineligible. Taking this into account, the Supreme Court adjourned the hearing and is set to deliberate on whether the new law applies or if the earlier legal provisions prevail.
