The Karnataka High Court has stayed the prison sentence imposed on Congress MLA Satish Sail by a special court for elected representatives in connection with the illegal transportation and sale of iron ore from Belekeri Port.
Justice M. Nagaprasanna of the single-judge bench issued the order while hearing an interim application filed by Sail, seeking a stay on the sentence handed down by the trial court.
The High Court also directed that until the final disposal of the appeal filed by Sail, no notification should be issued for a by-election in the Karwar constituency under Section 151 of the Representation of the People Act. Additionally, Sail has been barred from participating in the legislative assembly sessions, voting in the House, and receiving any salary or allowances as an MLA during this period.
The order further stated that the petitioner (Satish Sail) should not be disqualified from participating in any future elections while the appeal remains pending.
