New Delhi: A fugitive US citizen, wanted in Indonesia for causing death of a person due to medical negligence last year, has been sent to judicial custody by a Delhi court after his arrest following a Red Corner Notice.
Randall John Cafferty was arrested from Bengaluru Airport on September 29 following the Red Corner Notice.
He will have to face extradition proceedings in the special court here which is waiting for a formal extradition request to be forwarded by the Ministry of External Affairs (MEA). Duty Magistrate Sumeet Anand sent the fugitive to jail after the MEA submitted that Indonesia has sent a request for his provisional arrest as he was wanted for facing trial there.
Advocate N K Matta, appearing for the MEA, told the court that the formal request for extradition of the 56-year-old Cafferty was awaited and was likely soon. The judge directed jail authorities to produce him before Special Extradition Court of India in Delhi tomorrow. The judge also took the passport of the accused into its custody and directed the court staff to “ensure that under no circumstances the passport is mutilated”.
Cafferty was accused of committing various offences in Indonesia, including practising as a health worker without having appropriate licence and causing medical negligence which resulted in the death of the patient.
Indian and Indonesia have an Extradition Treaty in place since 2011.
