High Court issues notice to Speaker in rebel JD(S) MLAs matter

Bengaluru: The Karnataka High Court issued a notice to the Speaker of the Legislative Assembly on Wednesday to inform the court about his decision responding to the petition seeking to disqualify seven rebel JD(S) MLAs.
Justice Raghavendra Chauhan was hearing the petition which was filed by JD(S) MLAs C N Balakrishna from Shravanabelagola and B Ningaiah from Mudigere Assembly constituency, who have moved the court against seven of its rebel MLAs – B Z Zameer Ahmed Khan, N Cheluvarayaswamy, A B Ramesh Bandisiddegowda, H C Balakrishna, Akhanda Srinivasa Murthy R, Iqbal Ansari and S Bheema Naik – looking for their disqualification for violating the part’s whip and voting against the party’s candidates in the 2016 Rajya Sabha elections.
The bench orally watched that the court can’t issue directions to a Speaker yet can just demand the Speaker to speed up his choice with respect to the disqualification of the seven MLAs, ideally by April 30.
The court also orally watched that before a man is articulated to be disqualified in view of the discoveries by the authorities concerned, he can’t be considered as disqualified. The bench adjourned the issue for hearing to Thursday.
