Special case: Pocso accused given bail

Kundapur: A person identified as Uday from Kotabagilu in Tallur village, who was sentenced to jail under Pocso law for rape has been given conditional bail by Udupi Court.
The case
The mother of an underage girl had given a complaint stating that the accused had kidnapped her daughter. However, the police failed to apprehend the accused and girl.
After they were located, shocking news was revealed that both of them had married and that they even had a child. However, as per the law, having physical relationship with a girl beneath the age of 18 is considered rape and therefore the accused man was arrested by the police.
This is a special case and includes humanitarian issue, yet her marriage and her consent cannot be taken into consideration. The Udupi District and Sessions Court Judge Venkatesh Nayak listened to the arguments and counter arguments and then proceeded to provide conditional bail to the accused. Senior advocate Ravikiran Murudeshwara argued on behalf of the accused.
