Punjalakatte: Order cancelling alimony after wife’s second marriage upheld

The Bangalore Family Court upheld an earlier order by the Mangalore Family Court that revoked maintenance provided to a wife after it was revealed she had secretly remarried during divorce proceedings.

The case involves Uday Nayak, a resident of Panakaje, Mandadi, and his wife Anitha Nayak, who married in 2018. Due to marital disputes, the couple filed for divorce. However, during the ongoing proceedings, Uday alleged that Anitha had secretly remarried without his knowledge.

While the divorce case was still in court, Anitha had filed a petition seeking maintenance from Uday. After conducting hearings, the Mangalore Family Court revoked the maintenance order on the grounds of her remarriage. Challenging this decision, Anitha approached the Bangalore Family Court.

Justice Ashok S. Kinagi presiding over the case dismissed Anitha’s writ petition and upheld the earlier decision to cancel her maintenance. Advocates Vinod Shetty and Rajshekar represented Uday Nayak in the case.
