Pocso case; Youth gets 10 years

Mangaluru: A youth has been sentenced by the second additional district and session court (designated court for Pocso (cases), to 7 and 10 years of imprisonment to be run concurrently on charges of raping and impregnating a minor.
He convict has been identified as Krishna P R (23) who worked as a coolie. He has been held guilty of his crime under IPC Section 376 and Section 6 of Pocso. Public prosecutor Venkataramaswamy C represented the victim.
The crime
On September 8th, 2015, the convict Krishna came to the residence of the minor girl (13) who was alone. On the pretext of marriage he raped her. The girl became pregnant, but the pregnancy was terminated on the fourth month on the advice of the doctor, since it posed a threat to the girl’s life.
The case
The DNA match with the feotus and the victim’s statement before the magistrate under Crpc 164 nailed the accused to his crime. A total of 17 witnesses were examined in the case.
The sentencing
The sentencing was awarded by Judge B R Pallavi. The convict was sentenced to 7 years improsinment and fined Rs 5,000 under IPC Section 376, 10 years imprisonment and a fine of Rs 5,000 under Section 6 of the Pocso Act. Of the Rs 10,000, the court directed the convict to hand over Rs 7,500 to the victim. She is also entitled for compensation under the District Legal Services Authority.
